Establishing a Domestic Partnership Agreement

Even though same sex couples may not be legally recognized, they still face many of the same issues that married couples face upon separation. For example, same sex (gay or lesbian) couples may own property together and care for adopted children together. In these cases, it is a good idea to get a lawyer's help in drafting a domestic partnership agreement that spells out each party's rights and obligations pertaining to:

• How property will be divided upon a potential dissolution of the partnership
• Whether one party is entitled to support payments and for how long
• If there are children, how custody, visitation and child support will be shared

In many ways, a domestic partnership agreement is similar to a prenuptial agreement. By drafting it, you are not saying you expect the relationship to end.
